Child Support Attorneys

Understanding Child Support

How do I Apply for Child Support?

A party applying for child support must provide their:

• Last three pay stubs

• Most recent filed state and federal tax returns

• Verification of health insurance costs for the child

• Verification of childcare costs

How is Child Support Calculated?

In Kentucky, child support is calculated based upon a person’s gross income. Gross income includes any type of income received, including, but not limited to, salaries, wages, overtime pay, retirement and pension funds, Social Security and workers’ compensation benefits, gifts, prizes, and alimony.

If a parent is voluntarily unemployed or underemployed, then that person's potential income may be considered.

For a parent of a child under three (3) years of age other factors be taken into consideration.

How Long Can a Child Receive Support?

In Kentucky, child support must be paid until the child reaches the age of 18; however, if the child is 18 and still in high school, support must continue until graduation. If a child is disabled or otherwise doesn't graduate at age of 18 then other factors with child support may be considered.

Can a Child Support Order be Modified?

Child Support may be modified if there is a material change in circumstances. Kentucky law defines a material change as “a continuing change in circumstances, which results in at least a 15 percent increase or decrease in the amount of support due per month.” New calculations will have to be completed to determine if there is a material change in circumstances.

We at Lonneman & Associates understand that this can be a daunting process. Give us a call at (270) 765-2190 and schedule a free consultation to see how we can help you and your family.

Custody Attorneys

Few family law disputes can be more emotional than a child custody dispute. By securing experienced legal representation, however, you will likely increase your chances of finding an effective solution that protects your parental rights.

At Lonneman & Associates PLLC, our attorneys bring decades of combined experience to the table for our clients. From our law firm in Elizabethtown, Kentucky, and in courts throughout the region, we protect parents' and their children's best interests.

How Does Child Custody Work In Kentucky?

Unlike many years ago, most family law judges in Kentucky look toward giving both parents joint custody. In Kentucky, this means that parents will share in decision-making regarding their children's health care, education, religion and other welfare decisions.

It also means that parents may share "physical custody" of any children, or that one parent is labeled the primary residential custodian and the other receives parenting time. If one parent is granted sole legal custody, the other parent will likely receive visitation rights.

Parenting time can be hard to agree on. Many parents do not want to give up holidays, school vacations and weekends with their children. Whatever your desires are, our lawyers can use their knowledge of family law to provide you with the legal advice you need to make the right decisions regarding your children.

A Strong Background In Mediation

Parents here in Hardin County will have to go through mediation. Our attorneys have experience with mediation and representing clients in mediation, giving us deep knowledge of the process, its benefits and how to use the process to protect your rights.

Of course, some parents cannot work together, whether it is because of abuse or some other reason. We can aggressively advocate on your behalf at trial if necessary. Likewise, if you and your spouse can agree on a custody plan, we can review it to prevent you from signing an agreement that gives away any of your rights.

Estate Planning Attorneys

We here at Lonneman & Associates PLLC, understand how difficult the estate planning and probate processes are for most people. Estate planning causes you to have to think about the end of your life, while probate can be quite complex while you are also mourning the loss of a loved one.

Helping You Plan For The Future

Even if you do not have a large estate, crafting an estate plan is important. By making your wishes known now, you will remain in control of the process, instead of a judge. Our estate planning attorneys can help you with a:

Last will and testament that outlines how you want your estate to be distributed and which beneficiaries will receive which assets

Basic trust that can be used to keep your estate from going through the probate process

Living will that outlines your health care wishes if you cannot communicate them

Powers of attorney designation that grant someone else the authority to make health care or financial decisions on your behalf.

Appellate Attorneys

Whether you were convicted of a crime at trial or you do not agree with a family court ruling, judges and attorneys should respect your legal rights. Sometimes, though, that is not the case, which may give you suitable grounds to appeal.

Our lawyers at Lonneman & AssociatesPLLC, have deep experience appealing cases at all levels of the Kentucky judicial system, including before the Kentucky Supreme Court. If you come to our law firm in Elizabethtown for a consultation, we can answer your questions about the appellate process and help you decide the best way to proceed.

Successfully Appealing Your Case Is Difficult. Our Attorneys Can Help.

Almost anyone can appeal their trial ruling, but few are successful, making experienced legal representation a necessity. Our lawyers can review the record of your trial and determine if any errors were made, such as:

  • A judge refusing to admit evidence that would benefit your case
  • A judge refusing to allow witness testimony that would benefit you
  • Prosecutors improperly using evidence against you
  • Your attorney failing to provide proper representation
  • A judge refusing to accept a plea deal or settlement that you and the other side agreed to without proper reasoning

We will look at the evidence and research existing case law to help you determine the chances of success of an appeal. You can count on our lawyers to give you the legal guidance you need to protect your best interests and give you the best chance of achieving a successful appellate ruling.

Call Lonneman & Associates PLLC, For Appeals Help. Few attorneys in Elizabethtown or the surrounding region are better equipped to represent you in this complicated area of the law. Contact us today, either online or by calling (270) 765-2190 if you would like to schedule a free consultation.
